1 Introduction
1.1 By using the p2pbet (“App”, “the App”, “xApp”, “the xApp”) within the XUMM Wallet, you (“You”, “the Player”, “creator”, “taker”) agree to be bound by these Terms and Conditions (“T&C”). Please read them carefully before using our services. If you disagree with any part of these Terms and Conditions, you must not use the app.
1.2. p2pbet
1.2.1 p2pbet enables users to create and participate in friendly bets between two parties.
1.2.2 You can create bets in the categories of General, Sports, Events, and Abilities.
1.2.3 Private bets can be made using the r-Account as an invite.
1.2.4 Bets have three possible outcomes: Win, Lose, or Tie.
1.2.5 Creation of a bet does require the payment of a fee as displayed in the app.
1.2.6 We do not act as a bookmaker, we do not set odds, we do not participate in the bets in any shape for form, we do not arbitrage bets, we do not mediate disputes, we do not take a cut of potential payouts.
1.3 Wagers
1.3.1 Currently, wagers can be made using CSC and XRP.
1.3.2 The bet creator defines the wager amount and pays a 1 XRP fee for bet creation.
1.3.3 Both parties must pay the designated wager amount to participate in the bet.
1.3.4 A timeframe for acceptance can bet set, if the timeframe passed, the bet can no longer be taken.
1.4.Bet Outcomes
1.4.1 After the end time of a bet has passed, both parties can declare the outcome.
1.4.2 If both parties declare matching outcomes, funds are paid to the winner.
1.4.3. In case of a dispute, both parties have the opportunity to communicate via in-app messaging and can mutually agree on a judge to determine the outcome.
1.4.4 During beta stage all disputes result in a payback of the wager amounts to all parties, excluding the bet creation fee.
1.5.Dispute Resolution
1.5.1 xApp does not determine, judge, or mediate bet outcomes.
1.5.2. If a dispute arises, it is the responsibility of the parties involved to resolve the issue.
1.5.3 If no agreement is reached within 30 days, the deadman switch will activate, and funds will be released back to both parties, excluding the bet creation fee.
1.6.Limitation of Liability
1.6.1 The app acts solely as for wager management for funds and NFTs and is not responsible for any disputes, losses, or damages resulting from the use of p2pbet.
1.6.2 By using the service, you agree to indemnify and hold us harmless from any claims, damages, or losses.
1.7 Amendments
1.7.1 We reserve the right to amend these Terms and Conditions at any time without prior notice.
1.7.2 Your continued use of theapp constitutes acceptance of any amended terms.
By using the p2pbet, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
2 Eligibility to use xApp and p2pbet.app (website)
2.0 The App xApp is operated by Rok N Rolla Systems Rok N Rolla Systems N.V Abraham de Veerstraat 9 Willemstad, Curacao Reg. No. 149922, a company registered by the Government of Curaçao.
2.1 These Terms and Conditions apply to the usage of the app through related enabling internet, mobile or other platforms by you.
2.2 These T&C constitute a binding agreement between you and p2pbet.
2.3 These T&C come into force as soon as you click on the “ACCEPT” button, by doing which you signify to us that you have read these T&C and accept them. By using any p2pbet you signify that you agree with these T&C.
2.4 You must read these T&C carefully in their entirety before clicking on the “Accept” button. If you do not agree with any provision of these T&C you must not use or continue to use the app.
2.5 You fully understand and agree to be bound by the terms and conditions contained herein and as may be amended by us from time to time.
2.6 We reserves the right to modify and amend this Agreement at any time with or without notice.
2.7 Rules and explanations in respect to the betting provided separately on the app are incorporated into these T&C by reference.
3 ELIGIBILITY TO USE OUR SERVICES
3.1 You may participate in any of the betting if and only if:
3.1.1 You are over eighteen (18) years of age or such higher minimum legal age of majority as stipulated in the jurisdiction of Your residence; and
3.2 It is entirely and solely Your responsibility to inquire and ensure that You do not breach laws applicable to you by participating in xApp bets.
4. YOUR ACCESS
4.1 We reserve the right to refuse service to you.
4.2 Upon requesting a self exclusion, we will immediately prevent the player to acces the app. It’s the player’s responsibility to notify us of any other accounts the player might have. We will make reasonable efforts to try to prevent the usage via other accounts but it’s the player’s sole responsibility to make sure no other accounts can access the app. We cannot be held accountable for usage via other accounts.
5 FUNDS LOCKED IN BETS
5.1 You may only participate in wagering if you have sufficient virtual funds. For the avoidance of doubt, Virtual Funds shall mean cryptocurrency.
5.2 p2pbet is not a financial institution and thus should not be treated as such. Your account will not bear any interests.
5.3 p2pbet is not an exchange and therefore does not execute any conversion between and any cryptocurrency.
6 PAYOUTS
6.1 While we will endeavour to pay out payouts immediately, some may take longer than others. We shall try to pay out within 24 hours, however in some cases, payouts may take longer.
6.2 Payouts will be made to your wagering wallet account, this means the account the wager has been send from.
7 ACCOUNT
7.1 We reserve the right to block access to the app to our absolute discretion and without any obligation to state a reason or give prior notice.
8 YOUR OBLIGATIONS AS A PLAYER:
8.1 You hereby declare and warrant that:
8.2 You are over 18 years of age or such higher minimum legal age of majority as stipulated if the jurisdiction of Your residence (e.g. Estonia – 21 years) and, under the laws applicable to You, legally allowed to participate in wagering offered via the app.
8.3 You participate in strictly in your personal non-professional capacity for recreational and entertainment reasons only;
8.4 You participate on your own behalf and not on behalf of any other person;
8.5 All information that You provide to us during the term of validity of this agreement is true, complete, and correct, and that You shall immediately notify us of any change of such information;
8.6 You are solely responsible for reporting and accounting for any taxes applicable to You under relevant laws for any winnings that You receive from the app;
8.7 You understand that by participating in the app you take the risk of losing Virtual Funds;
8.8 You shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to your or third parties’ participation in app and shall not use any software-assisted methods or techniques or hardware devices for your participation in the app. We hereby reserves the right to invalidate any wager in the event of such behavior;
8.9 You understand that Virtual Funds are not considered a legal currency or tender and as such on the app they are treated as virtual funds with no intrinsic value.
8.10 You understand that currency value can change dramatically depending on the market value.
8.11 You are not allowed to use any payment methods that belong to a third party or person.
8.12 Some circumstances may arise where a wager is confirmed, or a payment is performed, by us in error. In all these cases we reserve the right to cancel all the wagers accepted containing such an error, or to correct the mistake made by re-settling all the wagers at the correct prices/spreads/terms that should have been available at the time that the wager was placed in the absence of the error.
8.14 Should the user become aware of possible errors or incompleteness in the software, he/she agrees to refrain from taking advantage of them. Moreover, the user agrees to report any error or incompleteness immediately to us. Should the user fail to fulfill the obligations stated in this clause, we have a right to full compensation for all costs related to the error or incompleteness, including any costs incurred in association with the respective error/incompleteness and the failed notification by the user.
8.13 We reserve the right to retain payments, if suspicion or evidence exists of manipulation of the system. Criminal charges will be brought against any user or any other person(s), who has/have manipulated the system or attempted to do so. We reserve the right to terminate and/or, change any offerings within the app.
8.14 We reserve the right to require some verification in case of suspicious or fraudulent transactions.
8.15 We reserve the right to declare a wager void partially or in full if we, at our own discretion, would deem it obvious that any of the following circumstances have occurred:
8.16 You, or people associated with you may directly or indirectly influence the outcome of an event, to obtain an unlawful advantage;
8.17 You and or people associated with you are directly or indirectly avoiding the rules of p2pbet;
8.18 The result of an event has been directly or indirectly affected by criminal activity;
8.19 Wagers have been placed that would not have been accepted otherwise, but that were accepted during periods when the app have been affected by technical problems;
8.20 Due to an error, such as a mistake, misprint, technical error, force majeure or otherwise, wagers have been offered, placed and or accepted due to this error;
8.21 If a player’s deposit fee is too low and is flagged by the blockchain or similar site as not enough fee to relay, we reserve the right to confiscate the winnings if we at their own discretion deem the transaction and behavior of the player to be fraudulent in nature.
9 PRIVACY POLICY
9.1 You hereby acknowledge and accept that it is necessary for us to collect and otherwise use your personal data in order to allow you access and use of the app and participation in betting.
9.2 We hereby acknowledges that in collecting your personal details as stated in the previous provision, we are bound by the Data Protection legislation. We will protect your personal information and respect your privacy in accordance with best business practices and applicable laws.
9.3 We will only use your personal data to allow you to participate in betting and to carry out operations relevant to your participation in betting. All members of the staff shall have access to your personal data for the purpose of performing their duties.
9.4 Your personal data will not be disclosed to third parties, unless such disclosure is necessary for processing of your requests in relation to your participation in betting. You hereby consent to such disclosures.
9.5 As an individual you may exercise your right to access the data held about you by us by submitting your request in writing. Although all reasonable efforts will be made to keep your information updated, you are kindly requested to inform us of any change referring to the personal data held by us. In any case if you consider that certain information about you is inaccurate, you may request rectification of such data. You also have the right to request the blocking or erasure of data which has been processed unlawfully.
9.6 In order to make your usage of the app more user-friendly, to keep track of visits to the app and to improve the service, the app collects a small piece of information sent from your device.
9.7 We may also inform you of changes, new services and promotions We think that you may find interesting.
10 COMPLAINTS
10.1 You may contact our customer service according to the instructions located at the app to give us any complaints regarding our services by sending an email to [email protected].
10.2 Complaints are handled in the support department and escalated in the organization of us in the case that support personnel do not solve the case immediately. The player shall be informed about the state of the complaint to a reasonable level. This may take up to 5 business days.
10.3 In the event of any dispute, you agree that the records of the ledger shall act as the final authority in determining the outcome of any claim.
10.4 When we wish to contact you regarding such a dispute, we will do so by using any of your contact details.
11 LIMITATION OF LIABILITY
11.1 You enter the App and participate in betting at your own risk. The app is provided without any warranty whatsoever, whether express or implied.
11.2 Without prejudice to the generality of the preceding provision, company, its directors, employees, partners, service providers:
11.2.1 Do not warrant that the software or the app is fit for their purpose;
11.2.2 Do not warrant that the software and app are free from errors;
11.2.3 Do not warrant that the App will be accessible without interruptions;
11.2.4 Shall not be liable for any loss, costs, expenses or damages, whether direct, indirect, special, consequential, incidental or otherwise, arising in relation to your use of the app or your participation in betting.
11.3 You hereby agree to fully indemnify and hold harmless the company, its directors, employees, partners, and service providers for any cost, expense, loss, damages, claims and liabilities howsoever caused that may arise in relation to your use of the app or participation in betting.
11.4 Nothing published by or on behalf of us constitutes solicitation or recommendation to enter any security or investment. Neither content nor data published by us should be relied upon for investment, trading, or security purposes. Links to other sites do not constitute endorsement and should not be deemed as such, nor should such links be considered approval by us of the linked site, its owner, or its content. It is strongly advised that anyone perform independent research prior to making financial or investment decisions, along with seeking the advice of a qualified professional.
12 BREACHES, PENALTIES, AND TERMINATION
12.1 If you breach any provision of these T&C or we have reasonable grounds to suspect that you have breached them, we reserve the right not to suspend your activity.
12.2 You acknowledge that we shall be the final decision-maker of whether you have violated our rules, terms, or conditions in a manner that results in your suspension or permanent barring from participation in our services.
13 INTELLECTUAL PROPERTY RIGHTS
13.1 All App design, text, graphics, music, sound, photographs, video, the selection and arrangement thereof, software compilations, underlying source code, software, and all other material contained within the App are subject to copyright and other proprietary rights which are either owned by us or used under license from third-party rights owners. To the extent that any material contained on the App may be downloaded or printed, such material may be downloaded to a single personal computer only and hard copy portions may be printed solely for your own personal and non-commercial use.
13.2 Under no circumstances shall the use of the App grant to any user any interest in any intellectual property rights (for example, copyright, know-how, or trademarks) owned by us or by any third party whatsoever.
13.3 No rights whatsoever are granted to use or reproduce any trade names, trademarks, or logos which appear on the App except as specifically permitted in accordance with the Terms of Use.

14 SEVERABILITY
14.1 If any provision of these T&C is held to be illegal or unenforceable, such provision shall be severed from these T&C, and all other provisions shall remain in force unaffected by such severance.
15 ASSIGNMENT
15.1 We reserve the right to assign or otherwise lawfully transfer this agreement. You shall not assign or otherwise transfer this Agreement.
16 APPLICABLE LAW AND JURISDICTION
16.1 The Terms and Conditions stipulated below are effective as of June 1st, 2023. Before using the App, please read Terms and Conditions carefully. The fact of using the app confirms your consent with the Terms and Conditions.
